MFOA Receives Clarification on s. 357(1)(d) of the Municipal Act, 2001 and s. 323(1)(d) of the City of Toronto Act, 2006

Over the past year, MFOA has received questions from members with regards to s. 357(1)(d) of the Municipal Act, 2001 and s. 323(1)(d) of the City of Toronto Act, 2006. More specifically, questions have been raised as to whether these provisions would include business closures due to public health orders resulting from the COVID-19 pandemic.

MFOA has received clarification from the Ministry of Finance that these provisions are not intended to provide relief in a situation where a property has not been physically damaged or demolished.
